Terms and conditions of use

4. Registration: Obtaining THE SITE member code and password

4.1. To proceed to use the various features of THE SITE you will need to be of age, meeting the features described in section 3.1 above, have legitimate authority to dispose freely, under the conditions and purposes of THE SITE, of a house that, at the exclusive discretion of THE SITE, meets the specifications stated in the said paragraph 3.1 and you have also to duly complete and submit the appropriate registration form, which must be approved specifically. If you have an invitation code, please type it in the corresponding section.

4.2. The APPLICANT expresses his willingness to hire the service offered by V & S and in the event that your application is approved as described in these T&C, warrants on his own responsibility the accuracy of the information provided, to be kept up to date at all times, absolving V & S of the consequences and damage that the inaccuracy of it may cause to others.

4.3. In the event that the application for registration is approved by THE SITE the applicant shall be considered as Member of THE SITE. V & S will contact the person issuing the registration on the email address provided in the application to inform about said approval as well as the following:
a) Provide the user name and password (the codes) restricted access to THE SITE Member.
b) request to provide further information about the house (number of beds, if pet and / or children, if you have parking, etc..)
c) Require it, optionally, provide additional information about the house and its surroundings (interesting visits around, places to enjoy a good coffee, architectural curiosities, etc..)
d) request for payment of the relevant subscription fee, without which you cannot benefit from the functionalities of THE SITE.

The information contained in paragraphs b) and c) will be accessible to other members of THE SITE. The information provided by the Member of THE SITE may be amended at any time by accessing your personal profile, so you can be updated at any time and, in case there were errors in the information entered, they could be amended.

4.4. If, in the light of the information provided, additional information is necessary, it will be required in writing. In case it is not supplied, it shall be understood that the applicant waives to the application for registration.

4.5. Also, in the event that the application for registration is rejected, following the acceptance criteria specified by V & S to that end and which are contained in these T&C, V & C will also send the applicant the relevant written communication to inform about the rejection, proceeding to delete the application data.

4.6. Given that THE SITE does not intervene directly between THE SITE members interested in formalizing an exchange of property in the conditions they deem most appropriate, THE SITE shall not request the exact address of the house to be exchanged.

4.7. Notwithstanding the above, THE SITE will request authorization from the Members to display at least one of the photographs included in the application form so that they can be accessed by THE SITE visitors, provided that such disclosure is for the benefit only and exclusive Members THE SITE.

4.8. Photographs must have a minimum resolution of 450x450 pixels a maximum size of 2 Mb and can be edited conveniently by THE SITE to improve your visibility, always for the benefit of the member who has forwarded the picture.

4.9. The identification code of the Member of THE SITE and password are totally personal and non-transferrable, taking responsibility the Member before V & S and third parties for its improper use.

4.10. In the event of any loss or theft of passwords, unauthorized use of THE SITE or codes of any security violation thereof from which the member was aware of THE SITE, as well as any other incident , error, defect or deterioration of the service through THE SITE Member is obliged to notify V & S immediately.

In either case THE SITE will take the measures it deems appropriate, including, generating another ID and another key for THE SITE.

4.11. THE SITE has no technical means to check or the identity of those who register THE SITE. Therefore it assumes no responsibility for the actions of their members in case of theft of identity.

4.12. As stated, THE SITE goal is to create an exclusive network with very specific characteristics. Thus V & S reserves the right to reject any application for registration whose content does not meet the purposes and requirements of THE SITE and without implying any right to restitution, compensation, for the visitor whose application has not been accepted.

4.13. Persons who access THE SITE without being members can only access the pictures of the houses that each member has consented expressly disseminate as well as any information with regards THE SITE that AEH decides to make publicly available.

5. Code of conduct and terms of access and use of THE SITE

The correct behavior of the members of THE SITE is essential for the proper functioning of the service. Below is the code of conduct that they must follow to access and use THE SITE, indicating that compliance expressly described below is essential for the use of THE SITE.

5.1. Code of Conduct for Members of THE SITE

5.1.1. Members of THE SITE declare under their sole responsibility that have legitimate, free and peaceful right to use the apartment which they have included in the application form that has been approved by THE SITE and that there is no estoppel or otherwise limitation that prevents them from validly assuming obligations with regards home exchange as stated in the present T&C.

5.1.2. Members of THE SITE also declare under sole responsibility that the houses that provide for the exchange meet all the requirements of the applicable regulations for safety, health, habitability and suitability for use as housing and that said houses count with all the utilities required by to those rules. THE SITE Members agree to maintain such circumstances while remaining as a member, so that, in any case, there is no risk for the health or the integrity of the inhabitants of the exchanged houses.

5.1.3. Similarly, THE SITE Members represent and guarantee that their relationships with other members of THE SITE shall be made under you’re their sole responsibility and shall be governed by education, good faith, responsibility and utmost respect.

5.1.4 When they reach home swaps agreements, THE SITE Members shall pay special care and diligence in taking care of the home you will enjoy as if it were yours. Given the specificity of THE SITE Members may not engage in home exchanges in whose they will not participate personally.

5.1.5. Similarly, THE SITE Members undertake, under his own responsibility, to provide complete, accurate and truthful information about their business and their experiences regarding home exchanges made with other members of THE SITE.

5.1.6.Housing exchanges must be made for free, not being admissible any payment requirement for consideration.

5.1.7. THE SITE Members are expressly prohibited from conducting any of the following behaviors described below by way of example:
a) Creating false identities, acting on behalf of others without sufficient power or legitimacy and / or impersonating other people.
b) Entering false information and / or inaccurate in relation to the house offered for exchange and / or their professional activity, such information must be completely accurate and truthful.
c) Violation of third party rights, especially rights of industrial or intellectual property.
d) Entering advertises or performing any other activity in THE SITE different from the purposes listed in paragraphs 3.1 and 3.2 of these T&C.
e) Registering and using THE SITE without having sufficient capacity.
f) Failure to comply with the rules and default processes for access and use of THE SITE, using methods that may cause damage to THE SITE or third party systems.
g) Contacting other Members of THE SITE for purposes not related to house exchanging.
h) Spamming and / or sending unsolicited advertising, unless you have the express consent of the recipient.

5.1.8. THE SITE Members agree not to transmit through THE SITE, information on products or services of any kind or nature that is unlawful, libelous, defamatory, harmful, vulgar, obscene or otherwise objectionable.

5.1.9. V & S, in its sole discretion, may terminate access to THE SITE, immediately, without notice, if the conduct of a particular Member of THE SITE is not consistent with the present T&C and also in the event that becomes clear that the property offered for exchange does not meet the conditions required by these T&C.

5.1.10. THE SITE Members undertake to inform THE SITE and unsubscribe from the services offered when they lose the right to use the house for which they sought and obtained admission to THE SITE, regardless of the reason that such loss, as well as when, for whatever reason, the house ceases to comply the conditions set out in paragraph 5.1.2 above.

5.1.11. As an exception to the above provisions, THE SITE Members may maintain their membership when they move to a different house considered suitable for THE SITE provided they have applied for and obtained prior consent in writing.

6. Request for exchanges of housing through THE SITE

6.1. Once the member has obtained the keys THE SITE and is current in payment of the subscription fee will be ready to, among others, to seek contact with other member THE SITE to propose the exchange of their homes.

If the answer is positive and, indeed, there is interest in doing that the exchange, such members should contact each other to directly address the details and conditions of the proposed exchange.

6.6. - In relation to communications between members THE SITE and compliance with the rules of courtesy, Members are reminded of the importance of addressing THE SITE communications received from other members as soon as possible.

6.7. For the purposes purely exemplary, THE SITE provides Members a non-binding guide to the most common points of negotiation before formalizing the exchange. The guide can be accessed here.

6.8. Consequently, the relationships between the Member of THE SITE, whether in contacting each other, and / or related to the performance or breach of the agreements that they may have reached which will be governed by those terms and by the applicable law or regulations.

6.9. In any case, THE SITE has contract models available that can be used to write down the agreements reached. These models, which are not binding, are merely an aid without legal value by themselves, so that V & S does not assume any responsibility for their content and the consequences of its use.

6.10. THE SITE does not assume, in any case, any liability with regard to the identity of the members of THE SITE or on the nature of the proposals or the content of the covenants and agreements made between them, limiting its task, as specified in the previous sections, to bring together those Members of THE SITE and, where appropriate, to remind certain recommendations and warnings to help the home exchange experience satisfactory for both parties.

6.11. For the purposes of the provisions of the preceding paragraph, THE SITE provides in subsection FAQ, a good practice guide, tips, and practices relating to the exchange of homes, which should be considered first and, where appropriate, respected by all members of THE SITE.

6.12. 6.15. 7. Fees for access and use of the SITE and its various services

7.1. The access and use of the functionality of THE SITE by THE SITE Members shall be subject to payment of an annual subscription as specified in point 7.4.

7.2. Notwithstanding the above, the member may unsubscribe THE SITE at any time by written communication, without entitling you to a refund of any amounts satisfied.

7.3. Access to THE SITE it is subject to the payment of the current subscription fee.

7.4 The payment of the access fee shall be as specified in the notices sent to that effect and in the link below.

8. Links between Web pages

8.1. In the event that THE SITE includes links to websites operated by third parties, the Member of THE SITE may decide freely and under its responsibility the access and navigation by them with full indemnity of V & S, whether that link was introduced by V & S or by any other Member of THE SITE.

8.2. THE SITE members can create links between your profile THE SITE and Web pages or other Web pages or between them and THE SITE provided they do not contain materials and information that are immoral, abusive, that do not respect the laws, or that in any way, adversely affect the image of THE SITE.

8.3. In any case V & S shall be entitled to block access to content that is unlawful, libelous, defamatory, harmful, vulgar, obscene or objectionable in any way.

9. Intellectual Property

9.1. THE SITE member expressly acknowledges, for all purposes, that information, signs, images, designs, logos, animations, video, text and other elements and content, including its services and applications of THE SITE are subject to rights of intellectual property belonging to the sole owner, having V & S Property thereof or, where appropriate, the necessary licenses for exploitation, so they are not granted any rights on them except those expressly recognized.

10. Responsibility

The Member of SITE will be solely responsible for any damages that are caused to V & S, to any member and / or third party, which have cause in bad faith, illegality, untruth, inaccuracy, lack of diligence, failure to these T&C and / or object of any transaction, commitments or agreements to exchange homes or otherwise assume another member arising THE SITE and THE SITE use.

11. Protection and operation of THE SITE

13. Duration, suspension and resolution

14. Miscellaneous
